Phasing in

Meet an energy use intensity target for your building type, or comply through the investment pathway with an ASHRAE Level 2 audit. Your deadline depends on how big the building is.

Who it applies to
Commercial buildings over 50,000 square feet, excluding residential-only buildings.
If you miss it
Administrative penalties assessed by the Department of Commerce for buildings that miss their compliance date.

Date shown is for buildings 90,000 to 220,000 sq ft.

Clean Buildings Tier 2

Phasing in

July 1, 2027 · in 10 months

Benchmark the building and put an operations and maintenance program and energy management plan in place. Tier 2 buildings are not held to an energy performance target.

Who it applies to
Commercial and multifamily buildings between 20,000 and 50,000 square feet.
If you miss it
Administrative penalties assessed by the Department of Commerce. Programs must be operating by July 1, 2026 ahead of the reporting date.
