Clean Buildings Tier 1
Phasing in
Meet an energy use intensity target for your building type, or comply through the investment pathway with an ASHRAE Level 2 audit. Your deadline depends on how big the building is.
- Who it applies to
- Commercial buildings over 50,000 square feet, excluding residential-only buildings.
- If you miss it
- Administrative penalties assessed by the Department of Commerce for buildings that miss their compliance date.
Date shown is for buildings 90,000 to 220,000 sq ft.

Clean Buildings Tier 2
Phasing in
Benchmark the building and put an operations and maintenance program and energy management plan in place. Tier 2 buildings are not held to an energy performance target.
- Who it applies to
- Commercial and multifamily buildings between 20,000 and 50,000 square feet.
- If you miss it
- Administrative penalties assessed by the Department of Commerce. Programs must be operating by July 1, 2026 ahead of the reporting date.
